Social Media Evidence Used In DUI Cases

One would have thought that the link between social media and DUI would be quite tenuous.  However in the ever expanding world of social media there are so many consequences of putting your life online.  Most of us do it these days – sharing information, photos and videos with our friends and relations.  And there has been a lot of discussion about privacy laws as it related to social media.  Did you know that such information can be used against you if you have been charged with DUI?

DUI or Driving Under the Influence is a crime that authorities have been cracking down on for years.  In a nutshell it means driving drunk, or when intoxicated with drugs.  Usually in the US it relates to a blood alcohol content (BAC) of over 0.08% – although it can be less in certain circumstances.  The consequence of being charged with DUI can mean a large fine, driving restrictions and even prison.

Social media is now integrated into our society.  People use it for communicating and reaching out to people.  Many of the social media platforms allow the posting of large amounts of photos.  So if you are at a party or on a night out, the chances are good that a friend may take a photo of you, tag it and post it live.  This is itself is not too problematic unless you are caught in a compromising position and folks at your work see them.  Simply remove tags on the bad photos and you should be fine.

Problems arise if you have been charged with DUI and social media photos put you in a certain location at a certain time.  Other social items that can be used include tweets, status updates, posts and video.  Using this evidence the authorities can locate you at a particular place at a particular time.  Also they can find witnesses and get testimony from them.  This adds to the problems relating to your defense.

Your defense will have to look closely at this evidence if it is introduced.  Social media has not been around for long and there are no clear and cut answers.  If you are charged with DUI always contact an experienced DUI attorney for advice and representation with your case.
