The FBI has focused for many years, their efforts on detecting, investigating and prosecuting cases of money laundering, schemes involving accounting and doctoring the books, bribery, and any other case wherein a corporation has obstructed justice. Most cases of fraud against corporations are those involving fraud that is designed to deceive auditors, analysts and investors. This form of corruption involves falsifying the true condition of the financial status of the company.

Manipulation of this data is one of the most common forms of white collar crime. This affects not only the customers of a company those other companies in which they are partners, but it affects the shareholders as well. China has become one of the global business giants within about the past twenty years due to its intense focus on providing the best kind of business training programs possible. Each and every lawyer should act within the bounds of ethics, not just in the workplace, but in all aspects of life. Well, those practicing law today must find a balance between the time they spend in the office and the amount of time they spend at home or participating in activities that decrease the stress levels.

One lawyer, when questioned, stated that at one time she worked more than eighty hours a week, sometimes working for two or three days at a time with either very little sleep, or no sleep at all. The result was elevated stress levels which resulted in physical consequences. This personal balance must also take into account the responsibility each lawyer also has to the courts and to their clients. There are many regulations and rules, some written, some unwritten.

All of this must be taken into account with their overall goal of ensuring that justice is served. Intellectual property is a creation of the mind. Intellectual property is also referred to creations of a person’s mind, examples of this are: inventions, literary or artistic work, symbols, names and designs that are used in commerce.

There are also two subsets of intellectual property; there is industrial property and copyright. Intellectual property laws end up making like a temporary monopoly on an idea or product so that another group or person cannot use it for monetary gain. For example, all books or novels that are published have a copyright on the content so that others cannot use it and pass it off as their own work.

Intellectual property law is no new thing. It has been around since the 1800s. The term seems to have first appeared just after the French Revolution for the writings of Benjamin Constant, a French Liberalist.

The advent of the internet has made intellectual property law even more important. There was an instant when author Stephenie Meyer, author of the best-selling “Twilight” series had a manuscript she was working on called “Midnight Sun” hacked off of her computer and posted on the internet. The manuscript was her original novel “Twilight” from the perspective of another character, the vampire Edward Cullen, instead of her heroine Bella Swan.

The United States is not the only country that has laws and regulations concerning the bribery, and the prohibitions the governments of various countries place on officials and on business and financial companies. What is a unique aspect of the laws and regulations in the United States is that not only is the country concerned with corruption within the country, but throughout other countries, as well. The laws that govern the States extend to foreign transactions and officials similarly. One of the most well known and significant reflection of this ideology is the 1977 FCPA, Foreign Corrupt Practices Act.

The regulations outlined in the FCPA state that not only are those practicing bribery in corruption on companies within the country, those found to be practicing those same criminal acts with foreign companies or institutions are also prosecuted and penalized. There were previous statutes that regulated anti-corruption, prior to this Act of 1977, and those did inform and influence the creation of the FCPA. The FCPA is all encompassing. And those found guilty according to the FCPA may also be found guilty and penalized by the other statutes as well.

There are many forms of corruption throughout the companies and the governments of the world, from money laundering to embezzlement to the financing of terrorist organizations. The FCPA focuses on cases of bribery, be it in the form of the simple act of bribing officials of any country’s government or in the form of doctoring the accounting books. The regulations are meant to ensure that all money that is changing hands, is for services provided. Honest services provided. And to ensure that all transactions retain the utmost integrity and that those transactions are recorded accurately, with no misleading or falsified entries on the accounting documents being tolerated what so ever.
